What an expert instruction involves

An expert report is not an advocate's document. It sets out qualifications, the materials relied upon, the opinion and its reasoning, and any limits on that opinion, and it carries a signed declaration acknowledging the duty to the court. Our reports comply with Order 38 of the Rules of the High Court and the Code of Conduct for Expert Witnesses, and are written so a non-technical tribunal can follow the reasoning without taking anything on faith.

Adverse findings are reported plainly. Instructing parties are told early where the evidence points, including when it points against them; an expert who trims to instruction is worthless to everyone, starting with the client. Where cross-examination follows, we defend the method and the opinion without straying into advocacy.

What must a Hong Kong expert report contain?

Will you say if the evidence goes against us?
Yes, and early. Independence is the entire value of expert evidence; a report shaded to instruction fails at the first competent cross-examination.
