A summary of how every D3Forensics instruction is structured. The full terms are set out in the engagement letter issued before substantive work begins. Nothing here is unusual, which is the point: you should know the shape of the agreement before you make the first call.
Lawful authority first. We act only on lawful instruction where ownership, authority or consent over the device, account or data is established. We do not unlock devices without authority, access third-party accounts covertly, or monitor anyone without a lawful basis. Enquiries seeking any of these are declined.
Conflict check. Every enquiry is conflict-checked before matter detail is taken. If a conflict exists we decline, and we disclose the fact of the enquiry to no one.
Written scope and estimate. Work proceeds against a written scope: data sources, objectives, approach, deliverables and a costed estimate. Scope changes are agreed in writing. The initial confidential discussion carries no fee and no obligation.
Forensic method. Analysis is performed on verified, hash-validated copies, never the original. Every interaction with the evidence is documented, and methods are recorded so results can be reproduced and tested.
Confidentiality. Mutual confidentiality undertakings are included in every engagement letter and survive its termination. We do not reference clients or matters without written consent. NDAs on your paper are accepted.
Counsel direction. Where a matter is or may become contentious, engagements can be structured under direction of counsel to preserve legal professional privilege. We advise on this at the outset.
Deliverables. Instructions conclude with a written report and referenced exhibits. Where instructed, independent expert opinion is prepared in line with the Rules of the High Court (Order 38) and the Code of Conduct for Expert Witnesses, with the expert's overriding duty to the court paramount. Adverse findings are reported plainly.
Materials. Evidence and working data are returned or destroyed at conclusion as the engagement letter directs, subject to any legal hold.
Fees. No contingency or success fees. Expert evidence must be independent of the outcome of proceedings.
